If the die is on a single checker, not supported by any other object, it is valid. How is that different from a die on the surface, not supported by any other object being valid? We've all played on boards where the pips are not flush, and dice could be "tilted" more than 1%. But if it's only touching the surface, it's never been a problem.
The ONLY time you need to make a determination under EITHER rule is If the die is touching more than one surface or other object. In those cases, if it's not flat it's cocked. Same determination needs to be make regardless of whether it's on the surface or a checker.
With the old rule, if the die is touching the bar and is 1% off of horizontal, do you not call it cocked?
