I've been playing tournaments and twice weekly chouettes for the past two months or so.
My rulings for these two scenario would employ this simple tip that really helps to clarify the state of the die: Pull the checker(s) away from the wall.
Case #1 - Most assuredly that die will fall as it is being supported by the wall. Ruling: Cocked.
Case #2 - This dies appears to be laying flat on two checkers. Pull them away from the wall and I suspect the die will remain as it sits, if so ... Ruling: Legal.
This doesn't require Director intervention to assess. Players can easily use this tip to adjudicate the state of a die. However, I am perfectly happy to step in and do this assessment if requested. Easy peasy.
As I mentioned, we've been using this rule in club tourneys and chouettes, but early in I would find myself in chouettes where die on checker wasn't called at the beginning. I found it fairly irritating and archaic to have to re-roll dice on checkers that were perfectly evident. Now we have completely acclimated and die-on-checker is the default state for both chouettes and tournaments and no longer need upfront acknowledgement.
I don't believe the this rule was put in place to be some great time-saver.
I believe this rule is in place to enable rollers to always feel comfortable shaking their cup and rolling their dice with vigor ensuring a good random result even when rolling into a crowded bear-off board.
Any time savings are just gravy.
