Clearly, like me, you feel that there should not be a blanket ban on headphones; do you also feel that your opponent should not have the right to veto their use? Would you play in such an event if they did have?
With regard to chattering opponents, my understanding is that rules generally give us the right to require our opponents to play in relative silence. This is particularly relevant,of course, if clocks are used. If they are, and it is our opponents who is running, then we should certainly refrain from distracting them with chatter. Of course, if the players know each other well, and they enjoy banter with each other, this might not apply, at least some of the time anyway. But I don't believe that rules in general fail to give us any protection here. If the guy is distracting you, and he ignores your request for silence, then - just as if he kept not shaking his dice (after a warning from you) - would/should it not be 'director time'?
I can tell you that I personally do not feel 100% comfortable with my opponent using headphones, and I'm sure there are others who feel the same - even if they may say nothing to their opponents. MET's, Doubling Windows and Gammon Prices would be my main concern, rather than the much more involved scam you describe.
FWIW my own feeling is that, if baffle box and clock preference do not apply, if players have the right to insist on using headphones, and get at least equal precedence with their non-serial numbered opaque dice then I will be doing something else with my weekend.
If, however, they use the baffle box when they don't have to (I will have two or three different ones for them to choose from) then I will most probably not query or object to their use of headphones (where I could veto them), and I may ignore the possibility that their opaque dice are not kosher, and I might not require a clock when I could, or roll them for boards and so on.
Of course, at any tournament we are free not to play in it if we don't like the rules.
